1. General
Informacja Polonijna is operated by Pixelmesh, based in Arlington Heights, Illinois, USA (the "Operator"). The website informacjapolonijna.com (the "Site") is a directory of Polish-American and Polish businesses, organizations and institutions in the United States and Canada.
By using the Site you accept these Terms of Service. If you do not agree with them, please do not use the Site. How personal data is processed and how cookies are used is described in the Privacy Policy.
2. What the Site offers
- browsing and searching the directory – free of charge, no account required;
- adding your own business or organization listing – on the free plan;
- claiming an existing listing as its owner, after verification;
- paid plans (PLUS, PRO, MAX) that extend a listing's visibility, for example with featured placement in search results, additional categories or extra business details. The current features and prices are shown on the Plans page.
Listings marked "Sponsored" are shown in the featured places because their owner has a paid plan; the mark is not a recommendation by the Operator.
3. User accounts
Adding or claiming a listing requires an account. You agree to provide accurate information and keep it up to date. You are responsible for keeping your password confidential and for all activity carried out through your account. The Operator may suspend or delete an account used in breach of these Terms.
4. Listings and user content
By submitting a listing you confirm that you are entitled to publish the information, logos and images you provide and that they are accurate. Content that is unlawful, misleading, infringes third-party rights, is offensive, or consists of fictitious or duplicate listings is not permitted.
Listings are reviewed. The Operator may decline to publish a listing, change its category or wording to match the directory's standards, archive a listing that is no longer current, or remove a listing that breaches these Terms – without being required to give a reason.
By publishing content on the Site you grant the Operator a free, non-exclusive license to display, copy and distribute it within the Site and in materials promoting the Site.
5. Business information in the directory
Directory data comes from the businesses themselves, from publicly available sources and from users of the Site. The Operator makes reasonable efforts to keep it current but does not guarantee that it is complete or correct. This data is made available so that a business can be contacted; section 8 sets out what may be done with it beyond that. The "Verified business" mark means that the Operator confirmed the listing's basic details at a given time; it is not a guarantee of the quality of the business's services or products. The Operator may contact a listed business – by email, at the address its listing shows – about the listing (its verification, an update of its details) and about the Site's plans; a business can ask for such emails to stop at any time. If you represent a business listed in the directory, you can claim the listing and keep it up to date yourself, or ask for a correction or removal by writing to info@informacjapolonijna.com.
6. Paid plans and payments
- Payments are processed by an external payment provider (Stripe). The Operator does not store payment card details.
- Plans are billed monthly or yearly, as chosen at purchase, and renew automatically for the next period until canceled.
- You can cancel a plan at any time from your account dashboard. After cancellation the plan stays active until the end of the paid period, after which the listing returns to the free plan.
- Fees for a billing period that has already started are non-refundable, unless applicable law provides otherwise.
- Prices may change; a change does not affect a period that has already been paid for.
7. Liability
The Site is provided "as is". The Operator is not a party to any agreement or transaction between users and the businesses listed in the directory, and is not responsible for the quality of their services or products or for the content of their websites. To the fullest extent permitted by law, the Operator's liability to a user is limited to the fees that user has paid to the Site in the preceding 12 months.
8. Intellectual property and no permission to use the data
The Site's name, logo, design and software, and its database – including the selection, arrangement, categorization and compilation of the information about businesses – belong to the Operator or its partners and are protected by law. All rights that these Terms do not expressly grant are reserved.
The fact that information is visible on the Site is not permission to reuse it. These Terms grant no license or permission to use the Site's data, content or database – including business names, addresses, phone numbers, email addresses, websites, descriptions, categories, opening hours, logos, images and location data – for any purpose other than:
- browsing and searching the listings, and saving an individual contact detail, for your own use;
- contacting a listed business about its own services or products;
- sharing links to pages of the Site.
Without the Operator's prior written permission it is in particular not permitted to:
- copy, store, reproduce, publish, distribute, resell, license or otherwise use data from the Site, in whole or in part – including when it is collected piece by piece;
- build your own databases, lists, directories, maps or contact lists from it, or a service that competes with the Site;
- use it for marketing or sales to third parties – including sending unsolicited messages (spam), bulk emails or text messages, making bulk phone calls, building mailing lists or lead lists, or profiling individuals;
- use it to train, fine-tune, test or feed artificial intelligence or machine-learning models, to create datasets, indexes or embeddings, or for text and data mining – the Operator expressly reserves its rights in this respect;
- present data from the Site as your own, embed pages of the Site in frames, or create copies or "mirrors" of it.
Business data comes from the businesses themselves, from publicly available sources and from users – publishing it in the directory does not give anyone rights to reuse it further.
9. No scraping or automated access
It is not permitted to use robots, spiders, crawlers, scrapers, bots, scripts, browser extensions or any other automated or semi-automated tools to access the Site or to download, index, monitor or copy its content ("scraping"), or to retrieve data manually on a systematic or repeated large scale. It is also not permitted to:
- circumvent or try to circumvent the Site's technical protections and limits – rate limits, IP or account blocks, verification checks (such as Cloudflare Turnstile), login requirements, the robots.txt file – including by using proxies, multiple accounts, false identities, or by pretending to be a browser or a search-engine robot;
- load the Site in a way that disrupts its operation, or attempt unauthorized access to its systems, accounts or data;
- create accounts, or add, report or claim listings, by automated means.
This prohibition does not apply to internet search engines (for example Google and Bing) that obey the robots.txt file and index the Site only in order to show it in search results. It does not cover collecting data for any of the purposes listed in section 8, including training artificial intelligence models.
10. Technical measures and consequences of a breach
The Operator may use technical measures that detect and limit automated access – such as rate limits, user verification, and blocks of IP addresses and accounts – and may, without notice, block access to the Site and delete the account of any person or entity that breaches section 8 or 9.
A breach of section 8 or 9 is a breach of these Terms. The Operator may pursue every legal remedy available to it – including an order to stop the breach, to delete the data collected, damages, and reimbursement of the reasonable costs of enforcing its rights – and may report the breach to the competent authorities.
11. Permission to use the data
If you want to use data from the Site in a way that section 8 does not allow – for example under a cooperation, a partnership or a data license – write to info@informacjapolonijna.com. A permission is effective only if the Operator gives it in writing (email is enough); it covers only the purpose and scope stated in it and can be withdrawn.
12. Changes to these Terms
The Operator may amend these Terms. The current version, with the date of its last update, is always available on this page. Continued use of the Site after a change means you accept it.
13. Governing law
These Terms are governed by the laws of the State of Illinois, USA. Any dispute will be resolved by the courts having jurisdiction over Cook County, Illinois, unless mandatory law provides otherwise.
These Terms are drawn up in Polish; the English version is a translation provided for convenience. In case of any difference between the two versions, the Polish version prevails.
14. Contact
Questions about these Terms can be sent to info@informacjapolonijna.com.
